Capt. Aaron Rugh ordered the lead prosecutor removed from the case of Special Operations Chief Edward Gallagher after defense lawyers accused the prosecution of spying on their emails, according to the ruling. The defense asked Rugh to dismiss the case or remove prosecutors because of the surreptitious effort to track defense emails without court approval in an effort to find the source of news leaks. |
House panel threatens contempt of Congress vote against Barr, Ross Posted: 03 Jun 2019 02:29 PM PDT The top U.S. law enforcement officer and the Commerce secretary will face a contempt of Congress vote unless they hand over documents by Thursday on efforts to put a citizenship question on the 2020 census, the chairman of a House of Representatives panel warned on Monday. A number of big changes are in the works for families and video game fans. For starters, Apple is adding a much-requested feature in the form of multi-user support. This is particularly nice for large families where each person has specific tastes, allowing Apple TV to customize recommendations based on whoever is watching. For music, tvOS 13 will now provide live lyrics that scroll in sync with each individual song. It's a small tweak that could make Apple TV a big hit among karaoke fans. If the reaction of the crowd is any indication, the biggest change for tvOS comes in the form of third party controller support for games played through Apple TV. Apple has decided to embrace the biggest names in the business, with full support for both the Xbox One gamepad and the PlayStation DualShock 4. House Dems to Call Nixon Lawyer as First Witness in Mueller Report Hearing Posted: 03 Jun 2019 12:28 PM PDT Democrats on the House Judiciary Committee announced Monday that they will call John Dean, the former White House counsel to President Richard Nixon, as their first witness in the upcoming Mueller report hearings.The hearings, which House Democrats have titled "Lessons from the Mueller Report: Presidential Obstruction and Other Crimes," will begin June 10 and will primarily serve as a platform to further explore President Trump's alleged attempts to obstruct Special Counsel Robert Mueller's investigation."While the White House continues to cover up and stonewall, and to prevent the American people from knowing the truth, we will continue to move forward with our investigation," Judiciary Committee chariman Jerry Nadler said in a statement. "These hearings will allow us to examine the findings laid out in Mueller's report so that we can work to protect the rule of law and protect future elections through consideration of legislative and other remedies."Dean served as the star witness in the Watergate impeachment trial and ultimately pled guilty to obstruction of justice in 1973. Central Park Five Prosecutor Takes Fire Over Ava DuVernay Netflix Series, Calls It ‘Basket of Lies’ Posted: 04 Jun 2019 08:54 AM PDT Peter Kramer/NBC NewsWire via GettyLinda Fairstein is feeling the heat from prize-winning filmmaker Ava DuVernay's new Netflix miniseries, When They See Us, which portrays the retired New York sex-crimes prosecutor as a purveyor of injustice who racially profiled and railroaded the so-called Central Park Five three decades ago.A cancellindafairstein hashtag has been trending on Twitter in recent days. A petition demanding retailers and publishers pull her crime novels drew more than 40,000 signatures in a day. She was called corrupt, racist, and "the face of evil" on social media after the show premiered."It's a basket of lies," Fairstein, 72, told The Daily Beast as the furor spread this week. Ava DuVernay on the Central Park Five Case and Why She Treated Trump as a 'Footnote'Of course, Fairstein doesn't simply object to the Netflix miniseries; she has spent decades arguing against the evidence.Despite the fact that DNA from semen collected during the Central Park Five investigation never connected any of the teens to the savage 1989 rape of a white female jogger—and was ultimately matched to a convicted serial rapist and murderer who confessed to the attack in 2002—Fairstein has continued to defend the prosecution's judgment that the black teens were guilty. "Two juries heard that the DNA in and on the jogger's body was not from any of the 5—and still they convicted on the theory that the missing attacker, who had run with the crowd of 32 young men who rioted in the park, had not yet been caught," Fairstein wrote in a July 2018 New York Law Journal article. She argued that the prosecutors and investigators can't be blamed for their theory because there existed no national DNA database until a decade later that would have allowed them to identify the real rapist using the genetic materials collected from other crimes.Even before DuVernay's dramatization of Fairstein's role in the case, the ex-prosecutor faced repercussions. Last November, for instance, the Mystery Writers of America rescinded a "Grand Master" award it planned to give to Fairstein after bitter protests from its members.Fairstein, who has continued to defend her handling of the case and even claimed—in the same New York Law Journal essay—that the false confessions of the five teenagers were not coerced, has even been the target of demands that she herself be charged with prosecutorial misconduct."Even if it's 30 years later," Raymond Santana, one of the exonerated five, told TMZ. "She has to pay for her crime."DuVernay's four-part series has revived years of simmering outrage at the way New York's political, legal, and media establishments—personified by Fairstein—made scapegoats of five black teenagers who, as DNA evidence available at the time ultimately demonstrated, were innocent. The case remains a racially divisive and painful blot on a liberal-minded city that prides itself on diversity and inclusion.In 2002, after the five had already served more than a decade behind bars, convicted serial rapist Matias Reyes, who was already serving a life sentence for other crimes but was never considered a suspect in the Central Park attack, confessed to raping jogger Trisha Meili—which was quickly confirmed by the DNA evidence from semen discovered during the investigation.While Fairstein's boss, Manhattan District Attorney Robert Morgenthau, promptly recommended vacating the convictions of the Central Park Five—for whom real-estate impresario Donald Trump had purchased full-page newspaper ads demanding a revival of the death penalty—Fairstein remained unmoved."I think Reyes ran with that pack of kids," she told The New Yorker in 2002. "He stayed longer when the others moved on. He completed the assault. I don't think there is a question in the minds of anyone present during the interrogation process that these five men were participants, not only in the other attacks that night but in the attack on the jogger."In a phone interview with The Daily Beast, Fairstein attacked both the Netflix miniseries and DuVernay, who has claimed that Fairstein wanted to control how she was portrayed in the miniseries."Linda Fairstein actually tried to negotiate," DuVernay recently told Daily Beast Entertainment Editor Marlow Stern, saying she "reached out" to the former prosecutor, among others, as she was developing the Netflix project. "I don't know if I've told anyone this, but she tried to negotiate conditions for her to speak with me, including approvals over the script and some other things. So you know what my answer was to that, and we didn't talk." Fairstein's response to that? "It never happened," she said.Co-Director Ken Burns On the New 'Central Park Five' DocumentaryThe series dramatizes Fairstein—who is played by real-life college-admissions cheating-scandal felon Felicity Huffman—as the prime mover behind the police investigation and persecution of the five teens.Fairstein said that presents "a totally and completely untrue picture of events and my participation," including "putting words in my mouth that I never said in Oliver Stone fashion"—such as ordering the cops to conduct an indiscriminate sweep of Harlem for "black males" and "thugs." She said DuVernay erred in showing her dismissing DNA evidence that exonerated the five, and placing her at times, dates, and locations where she had never appeared.The series also presents a fundamental misrepresentation of how the Manhattan District Attorney's Office interacts with police investigators, Fairstein said.Far from supervising the investigation, as she's portrayed as doing by the Netflix series, "the police do the investigations and they don't let us [the prosecutors] in until they finish what they're doing," Fairstein said.Fairstein said she hired a lawyer to send DuVernay a detailed letter cataloguing the public record of the case but never heard from her again. She is accusing the documentary and feature-film director of orchestrating the public campaign against her."She's behind it," Fairstein said in a phone interview. "Her lies are behind it all."DuVernay didn't respond to a detailed request for comment emailed to her production company in Los Angeles.Fairstein added that the experience of being targeted on Twitter—she deleted her account on Monday—has been "dreadful."Several of the Central Park Five have been vocal in supporting a Fairstein boycott. Clothes, Sponges Stained With Missing Mom Jennifer Dulos’ Blood Found in Trash Cans: Police Posted: 03 Jun 2019 06:20 PM PDT New Canaan Police DepartmentAs authorities carry out a feverish search for missing Connecticut mom Jennifer Dulos, court records released Monday show that investigators have recovered clothes and sponges stained with her blood from trash cans in Hartford and based on cellphone tracking placed her estranged husband near the cans the night she disappeared.The new details were released in arrest warrant affidavits for Dulos' husband, Fotis Dulos, and his girlfriend, Michelle Troconis, who were formally charged in court Monday with tampering with or fabricating physical evidence and hindering prosecution, The Hartford Courant reports. The duo was held on $500,000 bond, and prosecutors told a judge they plan to file additional charged in the case. Troconis is reportedly out on bail, while Dulos is not. The newspaper reports that both have declined to cooperate in the investigation.Dulos, who has five children with Fotis Dulos and has been enmeshed in a bitter divorce proceeding for two years, has been missing since May 24.He'll 'Harm Me': Connecticut Mom Jennifer Dulos Missing Amid Two-Year Divorce BattleAccording to the warrants, police went to the mom's home after she failed to show up to multiple doctor's appointment in New York and concerned friends contacted police in New Canaan around 7 p.m. on May 24.Arriving officers found no one home but were able to gain access after friends encouraged a nanny to let police inside. During the search, officers found stains on the garage floor and on a vehicle in the garage, and evidence that someone had tried to clean up the crime scene, the warrants say.The also located a Chevy Suburban registered to Jennifer Dulos about three miles from her home, but no sign of her in or near the vehicle, the documents say.Based on what was recovered from the crime scene, "investigators came to the consensus that a serious physical assault had occurred at the scene and Jennifer Dulos was the suspected victim," the affidavit says.The next day, officers briefly interviewed Fotis Dulos, who met investigators with his attorney at his side and declined to assist in the investigation, but handed his iPhone X to a detective who seized the cellphone, believing it contained evidence of a crime, the affidavit says. Search warrants for the phone place the estranged husband in north Hartford on the night of May 24, the affidavit states. Investigators coupled the cellphone data with footage from surveillance cameras monitored by the Hartford Police Department that show a man who looks like Dulos and a passenger who resembles Troconis driving in a pickup truck that makes more than 30 stops along a four-mile stretch of Albany Avenue discarding trash bags that appear to be stained with blood, the affidavit says. The license plate on the truck appears to match one owned by Fotis Dulos and a sticker matching one on his truck appears in the surveillance footage as well, the affidavit says. The footage shows the bags being thrown into various trash receptacles and in once instance something being pushed through a storm grate, the affidavit states. Investigators responding to the storm grate recovered an envelope that contained two Connecticut license plates that were registered to a SUV owned by Fotis Dulos, the affidavit says. Investigators searched for the trash bags and recovered bags that are consistent with those seen on surveillance cameras, the affidavit says. Inside they recovered clothing that appeared to contain blood, kitchen items including a bloody sponge, and other pieces of evidence that are not detailed.A crime lab determined the blood from items recovered from the trash was that of Jennifer Dulos, the affidavit said.Read more at The Daily Beast.Got a tip? Don't you know that Jesus Christ — who probably didn't exist and most certainly wasn't divine — would have been on the front lines of smashing the patriarchy?The typical clique of secularists moonlighting as Christian exegetes was out in force this weekend, attacking Bishop Thomas Tobin for his unexceptional recitation of an article of the Catholic Church's bimillennial teaching on sexual ethics. His tweet set the Internet ablaze on Saturday, with Twitter users by the tens of thousands rallying to deride the Catholic prelate over the following statement: "A reminder that Catholics should not support or attend LGBTQ 'Pride Month' events held in June. They promote a culture and encourage activities that are contrary to Catholic faith and morals. They are especially harmful for children."The last line of his tweet, which invoked concerns about the safety of children, was met with predictable accusations of hypocrisy. On the merits, however, is he wrong? Why should children be subjected to any profligate display of sexuality, homosexual or otherwise?Bishop Tobin later apologized, stating that he was upset to learn that his "comments . . . about Pride Month have turned out to be so controversial in our community, and offensive to some, especially the gay community. But His love never prevented Him from insisting that people change their behavior. To quote an example that Cullen is no doubt familiar with, here is Christ's interaction with a rich young man in Saint Mark's Gospel (emphasis mine):> And Jesus looking on him, loved him, and said to him: One thing is wanting unto thee: go, sell whatever thou hast, and give to the poor, and thou shalt have treasure in heaven; and come, follow me.Christ's love is grounded not in license but in truth; in the famous case of the rich young man, even as Jesus "loved him," He still insisted that the man go and make a radically difficult decision to forgo temporal pleasure (could you imagine selling "whatever thou hast?") for the Kingdom of God.The bishop's statement is self-evidently correct. It is an unremarkable statement of fact that "Catholic faith and morals," in the bishop's wording, have been unanimous and unambiguous on the question of sexual ethics since the very first days of the Church.One is free to reject the validity of those values, but the bishop's statement, inasmuch as it plainly reflects the unchanging position of the Catholic Church on same-sex sexual behavior, should be beyond dispute.If you think the Church is wrong, say so. If you think that Jesus of Nazareth was an obscure first-century figure whose death was an ignominious event that sparked a group of schizophrenic followers to fabricate a resurrection story to assuage their consciences, say so. But you can't simultaneously claim the mantle of the New Testament and assert that John Q. Public, waywardly floating about in 21st-century Brooklyn and disconnected from organized Christianity, is speaking in persona Christi while the Church He founded is leading the flock astray. Though it may reasonably surprise an American public that has grown accustomed to the moral imprecision of the post-conciliar clergy, there are still prelates in the Catholic hierarchy who believe what the Church does and always has taught.Bishop Tobin is not a human-resources manager at a woke tech startup; he is a bishop in the Roman Catholic Church, subservient to the deposit of faith and an heir to the unbroken chain of apostles who have served in the episcopate over the past two thousand years. He has duties far higher than currying favor with Mia Farrow. |
